Revelation 18 Church will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations caused by a Force Majeure Event, i.e., an extraordinary event outside our reasonable control that prevents or substantially delays us from performing our obligations.
18. LIMITATION OF LIABILITY
Revelation 18 Church does not in any manner exclude or limit its liability for (a) death or personal injury caused by its negligence; (b) fraud or fraudulent misrepresentation; or (c) any other matter for which it would be unlawful for Revelation 18 Church to exclude or attempt to exclude its liability.
In no event will Revelation 18 Church, its affiliates, licensors, employees, volunteers, agents, officers, or directors be liable to you or any third party for any indirect, consequential losses (where consequential losses means loss arising as a side effect of the main loss) which are not a reasonably foreseeable consequence of such main loss or damage, including, but not limited to, (a) loss of assets or revenue; (b) loss of business; (c) loss of profits; (d) loss of anticipated savings; (e) loss of data; or (f) loss of property.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL REVELATION 18 CHURCH, ITS LICENSORS, AFFILIATES, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY SPECIAL, PUNITIVE, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM LOSS OF INCOME OR REVENUE, LOSS OF BUSINESS, LOSS OF PROFITS, LOSS OF ANTICIPATED SAVINGS, LOSS OF DATA, OR LOSS OF PROPERTY, WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND ON ANY THEORY OF LIABILITY, ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE WEBSITE OR OF ANY WEBSITE REFERENCED OR LINKED TO OR FROM OUR WEBSITE. YOU WILL BE RESPONSIBLE FOR ALL CLAIMS AND DAMAGES RESULTING FROM THE MISUSE OF THE WEBSITE BY YOU.

Except for any provisions determining the primary contractual obligations of the Participant and Revelation 18 Church herein, we have the right to revise and amend these Terms of Service from time-to-time to reflect changes in organizational needs, including, but not limited to, changes in features and functionality, changes in technology, changes in contribution methods, changes in relevant and applicable laws and applicable regulatory requirements, and changes in system capabilities. Changes are effective immediately upon posting, and your continued use of any of the Services following the posting of revised Terms of Service means that you accept and agree to the changes, to the extent permitted by applicable laws.
20. INDEMNIFICATION AND EQUITABLE RELIEF
The Participant agrees to compensate and fully defend Revelation 18 Church, its officers, employees, agents, successors, and assigns from and against any damages, losses, and expenses (including reasonable arbitration or legal fees) resulting from any third-party claim, action, or demand arising out of any breach by you of any representation, warranty, covenant, obligation, or duty of yours under this agreement.
You acknowledge that a breach of any confidentiality or proprietary rights provision of these Terms may cause Revelation 18 Church irreparable damage, for which the award of damages would not be adequate compensation. Consequently, we may institute an action to enjoin you from any and all acts in violation of those provisions, for which remedy shall be cumulative and not exclusive, and we may seek the entry of an injunction enjoining any breach or threatened breach of those provisions, in addition to any other relief to which Revelation 18 Church may be entitled at law or in equity.
21. SURVIVAL
All provisions relating to proprietary rights, contributions, confidentiality, disclaimer of warranty, indemnification, equitable relief, and limitation of liability shall survive the expiration or earlier termination of these Terms of Service.
22. GOVERNING LAW AND VENUE
These Terms shall be construed and governed by equitable laws according to the Bible. You agree to take all reasonable steps to resolve any issue directly with the concerned party(ies). If good-faith efforts fail to resolve an issue, you agree and accept that any lawful action or proceeding shall be adjudicated by Peacemaker Equity (PeacemakerEquity.com), and you expressly waive any objection to this venue or any invocation of forum non conveniens (another forum or court is more appropriate). Additionally, in the event of any dispute or claim relating to or arising out of these Terms of Service (including, but not limited to, any claims of breach of contract, tort, or infringement), you agree that all such disputes/claims will be resolved by means of arbitration or jury decision adjudicated by Peacemaker Equity.
If you are in the European Economic Area (EEA) or European Union (EU), these Terms and the relationship between you and us may be governed by the applicable laws of the EU/EEA member state in which you reside, or if domiciled, to the extent that these jurisdictions are applicable.
23. SEVERABILITY
If any provision of these Terms is held by a court of competent jurisdiction to be contrary to law, such provision shall be changed and interpreted so as to best accomplish the objectives of the original provision to the fullest extent allowed by law and the remaining provisions of these Terms will remain in full force and effect.
24. WAIVER AND AMENDMENT
If we fail to insist upon strict performance of your obligations under any of these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under these Terms, this will not constitute a waiver of such rights or remedies and will not relieve you from compliance with such obligations. No waiver by Revelation 18 Church of any default will constitute a waiver of any subsequent default, and no waiver by Revelation 18 Church of any of these terms and conditions will be effective unless it is expressly stated to be a waiver and is communicated to you in writing by us.
25. GEOGRAPHIC RESTRICTIONS
Revelation 18 Church is not obligated to provide any services to, or specific to, any country or region.
In the event that the Member is subject to United States export controls, software, functionality, and/or features (collectively, Service Functionality) may not be downloaded or exported (a) into (or to a resident of) Iraq, Cuba, Libya, North Korea, Iran, Syria, or any other country which the United States has sanctioned; or (b) to anyone on the United States Treasury Department's list of Specially Designated Nationals or the United States Commerce Department's Table of Deny Orders. By downloading or using any Service Functionality, you represent and warrant that you are not residing in, under the control of, or are a national or resident of any such country or on any such list. Although the Website may be accessible worldwide, we make no representation that materials on the Website are appropriate or available for use in your jurisdiction, and accessing them from territories and/or jurisdictions where their contents are illegal is prohibited. Those who choose to access the Website from forbidden jurisdictions do so at their own initiative and are responsible for compliance with all applicable laws. Any offer for any product, service, and/or information made in connection with the Services is void where prohibited.
26. ASSIGNMENT
No man, woman, or entity not a party to these Terms of Service will be deemed to be a third-party beneficiary of these Terms of Service or any provision herein.
The Participant may not transfer these Terms of Service, in whole or in part. Revelation 18 Church may transfer these Terms of Service and/or subcontract some or all of its obligations herein at any time.
27. POTENTIAL TRANSACTIONS
In the event of unforeseen circumstances while we continue to develop Revelation 18 Church, it is possible that we could undergo a change of leadership, such as a merger and/or a donation of all or substantially all of our assets to another church. In such transactions, Participant information is generally one of the transferred assets, and, by submitting any data or contributions (collectively, Data) to us, you agree that such Data may be transferred to such parties in these circumstances. However, any party inheriting our assets will be subject to an obligation to maintain the integrity of your personally identifiable information.
